NY Paid Family Leave Act Update

As promised, this is a follow-up to my email of September 6, 2017, regarding the implementation of the 2018 NY State Paid Family Leave Act. 

I've attached materials which I hope will be helpful to you.

The first is a comparison chart of the benefits and eligibility for the state Disability law and the Paid Family Leave Act, published by The Hartford Insurance Company.

The second sheet outlines the State of New York's tax guidance.  Employees should be notified in advance that you, as their employer, will be deducting the premium for this benefit on an after-tax basis. The premium deduction will be reported on their W-2. Note: the maximum allowable deduction is $1.65 per week or 0.126% of an employee's weekly wage.

The third attachment, also published by the State of New York, details the law in "plain English." Please note the section defining Employee Eligibility. If your church has part-time employees who work less than 20 hours per week and less than 175 days in a calendar year, you and your employee may waive participation in this benefit. The State will provide the waiver form before the end of 2017 on their forms webpage:   www.wcb.ny.gov/content/main/Forms.jsp  Both benefit programs are administered by the State of New York Worker's Compensation Division (even though these benefits are separate and distinct from the conference worker's comp. policy.)

Because of the nature of some church employees' work, they may not meet the basic eligibility standards. For a example: An organist, working two days per week and 10 hours per week, is not required to receive this benefit and can waive out. However, a church administrative assistant, working 4 days per week, averaging 20 hours, will be eligible.  An employee who works less than 175 days in a calendar year is most likely not eligible.
